Il s'agit de montrer que sur des terrains où Thomas rencontre nécessairement les juristes (canonistes et civilistes), et doit user de leur vocabulaire et de leurs références, il poursuit, sur le mode casuistique, l'effort pastoral élaboré depuis les premières Sommes de confesseurs et depuis le concile de Latran IV. Les échantillons d'analyse sont empruntés à des questions quodlibétiques portant, d'une part, sur l'argent, la propriété et la responsabilité sociale et, d'autre part, sur les sacrements et la liberté personnelle. Thomas délimite une autonomie du domaine pratique, lieu d'une relative indétermination morale ou d'un conflit réel de droits, mais susceptible d'une prise en charge progressive, d'une construction ascendante de la norme. Is there a practical ethic in Saint Thomas Aquinas's work? This article will show that there is, while distinguishing the subject from specifically doctrinal considerations on the general opposition between the speculative and the practical. The point is to show that in these areas where Aquinas necessarily encounters jurists (canonists and civils) and where he must resort to their vocabulary and their points of reference, he does pursue in a casuist fashion the pastoral effort elaborated in the first confessor's summae and at the fourth Lateran Council The samples used for analysis are taken from some of the quodlibets having to do wih money, ownership and social responsibility on the one hand, sacraments and individual liberty on the other hand. Aquinas defines an autonomy of the practical domain, one of relative moral indetermination, or of real conflicts of rights, yet susceptible to being progressively covered or to becoming a mounting construction of norms. | ||
