L'étude rappelle d'abord la grande codification de l'Église catholique, le Code de 1917, avec les évolutions historiques et intellectuelles qui l'ont rendu désuète, — ainsi que les expériences protestantes condensées dans la Confession de Barmen. Sont ensuite évoqués les grands mouvements des idées et des moeurs, qui sapent les justifications théologiques des structures de l'Église, et qui obscurcissent l'originalité du droit par rapport à la théologie, comme la nécessaire inclusion mutuelle de ces deux disciplines. A l'occasion des travaux du groupe de l'Evangelische Studiengemeinschaft de Heidelberg et de son examen de la Lex Ecclesiae Fundamentalis et de la Concorde dite de Leuenberg, l'auteur propose enfin quelques pistes de recherche: compréhension sociale et universelle du salut chrétien, Église comme 'communion', responsabilité commune des chrétiens en ce moment très critique de l'histoire humaine. An examination of the relationships between law and theology in contemporary historical and ecclesiastical contexts. The study first of all recalls the great codification of the Catholic Church, the Code of 1917, and the historical and intellectual developments which have made it obsolete, and in a similar way with the protestant experiences summed up in the Confession of Barmen. Then it calls to mind the great movements of ideas and ways of behaving which undermine the theological justifications of the structures of the church, and which also obscure the particular nature of law in relation to theology but also the necessary mutual interdépendance of these two disciplines. The group-work of the Evangelische Studiengemeinschaft of Heidelberg and its examination of the Lex Ecclesiae Fundamentalis and the so-called Agreement of Leuenberg, give the author the opportunity to finally propose some paths of research: the social and universal understanding of Christian salvation, the church as 'communion', the common responsibility of Christians at this very critical moment of human history. | ||
