Summary: | The legal standing today of the Reichskonkordat of 1933 was determined in a legally and logically problematic but still binding decision by the Federal Constitutional Court on 26 March 1957. Since then the Concordat is binding law; however, the Federal government is not authorized to force individual Länder to observe the school regulations established by the Concordat. Repgen handles this famous court case by observing three stages in the background. First, he describes the political handling of the legal validity question under the occupation powers and the same problem by the Adenauer government (1949/53). Finally he deals with the circumstances mediately and immediately preceding the trial (1954/55). The article is based in essential parts on newly opened state and church archives. |
