| Summary: | Canons 1333 §3.1 and 1338 §1 mention the «Superior who establishes the penalty». In Book VI «establishing a penalty» (poenam constituere) means an action carried by the law more than the Superior. For this reason the reading of both canons may appear confusing and in contradiction with some other norms. A detailed analysis allows suggesting another reading that could have been better. It is also possible to discuss if there would be another substantial approach to this canons. Los cc. 1333 §3.1 y 1338 §1 se refieren al «Superior que establece la pena». En el Libro VI «establecer una pena» (poenam constituere) se refiere a una acción que corresponde más a la ley que al Superior. Por eso la redacción de los cánones puede resultar confusa e incoherente con otras disposiciones. Un análisis detallado permite proponer una redacción que hubiera sido más acertada. Incluso es posible discutir si no habría para estas normas un enfoque de fondo alternativo. |
