| Summary: | The norms of the year 2010 about delicts reserved to the CDF integrate numerous concessions granted by the Pope to this dicastery after the norms of the year 2001 about the same matter. The procedural peculiarities for these delicts are mainly the necessary sending to the CDF by the Ordinary the investigation he may carry out at the news of a delict, the possibility to follow, according to the decision of the CDF, a procedural way judicial or administrative (this even to impose the expulsion from the clerical state), the exclusive competence of the CDF for the second instance and the possibility to adopt the precautionary measures of canon 1722 even during the investigation stage. Las normas de 2010 sobre delitos reservados a la CDF integran numerosas concesiones recibidas del Papa por este dicasterio con posterioridad a las normas sobre esa misma materia del año 2001. Las particularidades procesales para estos delitos son, fundamentalmente, la necesaria remisión a la CDF por parte del Ordinario de la investigación que realice ante la noticia de un delito, la posibilidad de seguir, según decida la CDF, una vía procesal judicial o administrativa (ésta incluso para imponer la expulsión de estado clerical), la competencia exclusiva de la CDF para la segunda instancia y la posibilidad de adoptar las medidas del canon 1722 incluso en la fase de investigación. |
