| Summary: | The Instruction Potestas Ecclesiae, of the Congregation for the Doctrine of the Faith, contains the new procedural norms to be observed in the administrative process for the pontifical dissolution of a non-sacramental marriage. In this article, the author analyses this process, excluded from the Code of Canon Law, trying to solve some difficulties and quaestions caused by the new Norms: what are the conditions needed for the validity of the dissolution? Can the non-sacramental matrimonial bond be solved without the intention of celebrate a new marriage? What are the effects of the pontifical rescript? La Instrucción Potestas Ecclesiae, de la Congregación para la Doctrina de la Fe, contiene las nuevas normas procesales que deben observarse en la tramitación del procedimiento administrativo para la disolución pontificia del vínculo de un matrimonio no sacramental. En este artículo, la autora analiza este procedimiento, excluido del Código de Derecho Canónico, intentando resolver algunas dificultades e interrogantes causados por las nuevas Normas, como las relativas a cuáles son las condiciones necesarias para la validez de la disolución, la posibilidad de disolver el vínculo a favor de la fe sin intención de contraer nuevo matrimonio, o cuál es el contenido y efectos del rescripto pontificio concediendo la gracia. |
