Focusing on the specificity of some definitive sentences in which, hypothetically speaking, the ratio decidendi may be identified as an indispensable assumption of precedent, the paper emphasises some advantages of judgement based on precedent. Drawing on an analysis of its legal activity, it may be concluded that judgment via precedent is, for the time being, a principle of lege ferenda. | ||
