| 520 | |a L'articolo intende verificare e spiegare la peculiarità della facoltà di delegare la potestà di regime esecutiva, che nel Codice appare, a differenza della facoltà di dispensare (cf can. 90), sganciata dalla necessità di una causa canonica che la giustifichi. La ratio di tale libertà si presenta multiforme: dalla "proprietà" della potestà ordinaria delegabile, alla relazione intrinseca tra ufficio e ambito di delega, ma soprattutto alla flessibilità e adattabilità della potestà alle molteplici e imprevedibili condizioni concrete nelle quali l'esercizio dell'ufficio viene a trovarsi e nelle quali deve raggiungere il suo fine. L'intrecciarsi di potestà ordinaria, organizzata in una struttura gerarchica di uffici, e di potestà delegata, da questa struttura sganciata, richiede, oltre all'accurata stesura del decreto di delega, l'applicazione dei consueti istituti giuridici circa il cumulo di giurisdizioni e competenze, per neutralizzare la potenziale conflittualità che potrebbe innescarsi. | ||

The rationale for this freedom is multifaceted: from the "ownership" of the ordinary power that can be delegated, to the intrinsic relationship between office and the sphere of delegation, but above all to the flexibility and adaptability of the power to the multiple and unpredictable concrete conditions in which the exercise of the office finds itself and in which it must achieve its purpose. The intertwining of ordinary power, organized in a hierarchical structure of offices, and delegated power, from this detached structure, requires, in addition to the careful drafting of the decree of delegation, the application of the usual juridical institutions regarding the accumulation of jurisdictions and competences, in order to neutralize the potential conflict that could arise. | ||
