| 520 | |a Premessa una ricostruzione sintetica delle linee essenziali della giurisprudenza costituzionale e di quella della corte europea sulla libertà di culto, l’articolo si prefigge di indagare le assonanze fra il criterio della pacifica convivenza, annoverato dalla corte costituzionale fra gli «interessi costituzionali» da tenere in considerazione nel modulare la libertà di culto, e quello del rispetto delle condizioni minime del «vivre ensemble» accolto dalla corte europea, in via eccezionale, come fine legittimo di restrizioni al diritto di manifestare la propria religione. L’articolo difende la tesi secondo cui tali assonanze esistono: muove da come il ‘vivre ensemble’ è stato concretizzato nei procedimenti davanti alla corte europea (e davanti ad altre corti supreme e organismi internazionali in europa), e propone argomenti su come dovrebbe esserlo nell’ordinamento italiano. L’articolo esamina tali dinamiche nel contesto del pluralismo religioso che contraddistingue le società europee, evidenziando l’esigenza del suo governo da parte delle autorità statali ed evidenziando che la cross-fertilization fra Corti supreme può essere veicolo non secondario di individuazione di soluzioni che siano in armonia con il rispetto dei diritti fondamentali e con la preservazione del tessuto sociale. | ||
| 520 | |a After summarising the salient findings of the case law of the italian constitutional court and of the European Court of human rights on freedom of worship, the aim of the article is to investigate the possible analogies between the ‘pacifica convivenza’, which the consulta has included among the ‘constitutional interests’ to be taken into account when modulating freedom of worship, and the respect for the ‘minimum conditions of living together’ accepted by the european court, on an exceptional basis, as a legitimate aim of restrictions on the right to manifest one’s religion.
