Summary:This study centers on a case of a doubtfully valid baptism which is analysed at length by Franz Xavier Schmalzgrueber in his 1740 work, Consilia seu responsa iuris. The case concerns the petition for a new baptism of a woman who believes her first baptism to have been invalid. The A. presents Schmalzgrueber’s treatment of conditional baptism when there is a reasonable doubt of fact or law concerning a prior baptism. The study concludes with a brief discussion of the contemporary relevance of Schmalzgrueber’s Consilium 73.
Cette étude est centrée sur un cas de baptême douteusement valide qui est analysé en détail par Franz Xavier Schmalzgrueber dans son ouvrage de 1740, Consilia seu responsa iuris. Le cas concerne la demande d’un nouveau baptême d’une femme qui estime que son premier baptême n’était pas valide. L’A. présente le traitement par Schmalzgrueber du baptême conditionnel lorsqu’il existe un doute raisonnable de fait ou de droit concernant un baptême antérieur. L’étude se termine par une brève discussion sur la pertinence contemporaine du Consilium 73 de Schmalzgrueber.
