The arguments put forward by De Augustinis were not considered proving by Leo XIII. Yet, the Constitution Sacramentum Ordinis (30-XI-1947) of Pius XII, entirely based on the concept of the substance of the sacrament,does not exclude the possibility that the formula Accipe Spiritum Sanctum be a valid form of ordination. Has what was affirmed by De Augustinis in 1895/96 but not approved, been admitted in 1947? To contribute towards an answer to this question the present article examines the following points: the concept of substance of the sacrament of Order in De Augustinis and in the Constitution Sacramentum Ordinis of Pius XII; the aspect of the question of the requirements for the sacramental form of Order in the different rites, which De Augustinis and the discussion of his time bypassed rapidly, while on the contrary it appears fundamental in the evaluation of Pius XII, and before him of Leo XIII in 1896. The question is thus asked of the theological context in which the form of ordination is prepared and of the power of the Church to examine and determine what is concretely required for a valid form of sacred ordination.
