La frattura ivi introdotta fra rectitudo naturalis oggetto dell’intenzione razionale e il fattuale determinarsi della volontà offre infatti il terreno concettuale entro cui la critica moderna - quale si esprime nella legge di Hume - è suscettibile di prosperare. Di fronte a tali criticità, il ricorso alla volontà del Deus Legislator configura un debole rimedio, suscettibile di garantire la tenuta di un ordine naturale positivisticamente inteso, destinato tuttavia a declinare, nell’epoca della morte di Dio, lasciando dietro di sé l’insoluta dialettica di ragione e volontà, alla base delle difficoltà contemporanee. The article points out how the suaresian teaching on natural law, rooting both in an abstract conception of reason and in a definition of freedom in terms of self-determination, did provide the theoretical context in which the crisis, faced by contemporary reflection on natural law, has been able to develop. The caesura there introduced between the rectitudo naturalis, as intended by reason, and the actual self-determination of will, would provide the suitable conceptual background for the development of modern criticism, as represented by the so-called “Hume’s Law”. Within such a perspective, the hint at the will of the Deus Legislator as the ultimate ground of natural law, could provide but a weak foundation, which may afford a merely positivistic understanding of moral obligation, and which would soon collapse in the age of God’s Death, leaving behind itself the unsolved dilemma between reason and law, this being the ultimate ground of contemporary crisis. | ||
