Among those goods which the Salamanca authors regarded as common to all mankind, we can list the great sea, the water, the enviroment and the space (locus). The author summarizes the Catholic contribution to the Montego Bay Convention (viz the United Nations Convention on the Law of the Sea, 1982), with special attention to the role played both by the Jesuit Emmanuel Saguez de Breuvery (1903-1970), who inspired such a contribution, and, in regard to the discussions that preceeded the final agreement, by the Holy See. Date alcune indicazioni sul moderno diritto del mare, l’articolo mostra come esso tragga il suo sviluppo dalla posizione di tre autori spagnoli della Scuola di Salamanca, che si rifanno alla Creazione del mondo da parte di Dio per tutta l’umanità. Parte dei beni sono stati poi privatizzati, mentre parte sono rimasti «bene comune dell’umanità», come l’ampio mare, l’ambiente, l’acqua, lo spazio. L’autore riassume quindi il contributo cattolico alla Convenzione sul Mare, mettendo in luce il ruolo del gesuita che la ha ispirata e quello della Santa Sede nel corso dei dibattiti. | ||
