Those working in constitutional theory cannot preserve their intellectual integrity while ignoring his arguments., In this book, Arkes finds the natural law in unexpected places. Take, for instance, his illuminating discussion of the U.S. Constitution's ban upon ex post facto laws. An ex post facto law is an “after-the-fact law”—a law that takes into account actions already performed. Yet some “after-the-fact” laws have been upheld by the Supreme Court.
