Sans doute la solution au problème méthodologique actuel réside-t-elle dans la redécouverte du caractère matériel et substantiel de la rationalité du droit canonique. If the code of 1917 claims to be in perfect continuity with the canonical tradition, by giving the majority of the new canons a reference to the previous laws, it seems however that the first codification, the exegetical interpretation of the code itself linked to a certain juridical positivism have generated a distance between the historical and canonical sciences, making the concept of the history of canon law problematic. The solution to the present methodological problem lies in the rediscovery of the material and substantial nature of the rationality of canon law.
