Im Gespräch wird deutlich, dass sich hier Fragen der Moderne widerspiegeln, die auch gesellschaftlich zunehmend zugunsten individueller Singularitäten entschieden werden. Die Verständigung auf Verfahren der Konstituierung des Allgemeinen, über Konsense oder gemeinsame Haltungen der Gemeinschaft scheint gegenwärtig eine gesamtgesellschaftliche Aufgabe zu sein. Das Eintreten der Kirchen für die Anerkennung der Kategorie christlicher Dienstgemeinschaft ist insoweit Teil der Verantwortung für den Zusammenhalt der Gesellschaft. Und sie findet auch in den antidiskriminierungsrechtlichen Regelungen ihren passenden Anknüpfungspunkt. In several judgments on anti-discrimination disputes, the ECJ and the BAG have strengthened the individual rights of applicants and employees at the expense of the religiously determined and constitutionally guaranteed right of the Church, Diakonie and Caritas. In a conversation, it becomes clear that those judgements reflect questions of modernity, which are increasingly being decided socially in favor of individual singularities. At the present time, it appears to be a task of the society as a whole to agree on procedures for the constitution of the general, on consensus or common attitudes of the community. The commitment of the churches to the recognition of the category of a Christian service community is in this respect part of the responsibility for the cohesion of society. Moreover, it finds its matching point of reference in the anti-discrimination law. | ||
