Pourtant, la déjudiciarisation n’a suscité que peu de commentaires et encore moins de théorisation parmi les chercheurs en sciences sociales qui étudient la liberté religieuse. Cet article conceptualise la déjudiciarisation de la liberté religieuse (DLR) en termes institutionnalistes, examine les forces structurelles qui ont facilité la JLR, et analyse à quelles conditions et comment ces dernières ont diminué ces dernières années. Nous estimons que les conditions favorables à la déjudiciarisation en général, et à la déjudiciarisation de la liberté religieuse en particulier, sont déjà en train d’émerger; nous mettons en évidence les développements récents qui sont compatibles avec un tel tournant; et nous proposons une typologie des formes que la déjudiciarisation de la liberté religieuse est susceptible d’adopter. | ||

Yet, dejudicialization has provoked a little comment, and even less theorization, among social scientists studying religious freedom. This article conceptualizes the dejudicialization of religious freedom (DRF) in institutionalist terms, examines the structural forces that have facilitated JRF, and considers whether and how they may be waning in recent years. We argue conditions favorable toward dejudicialization in general, and DRF more specifically, are already emerging; highlight recent developments consistent with such a turn; and develop a typology of the forms that DRF may take. | ||
