AB Este artigo apresenta o paradoxo no pensamento de Edith Stein entre suas atividades relacionadas ao problema Estado/Direito e sua visão sobre Re-ligião. O artigo busca explicar o paradoxo através do estudo da Teoria do Estado  e  Soberania.  Neste  sentido,  baseando-se  em  problemas  clássicos, Edith  Stein  não  concorda  com  a  maioria  dos  juristas  de  seu  tempo  que nem sempre reconheciam a prioridade do conceito de soberania. O exa-me da relação entre Estado e Direito rompe novos argumentos com a sua posição  fenomenológica,  por  um  lado  defendendo  um  forte  conceito  de soberania  de  Estado  vista  como  a  priori  de  direito  enquanto,  por  outro lado, observando que o Estado não se relaciona a valores espirituais. Isso nos  leva  a  propor  esta  visão  particular  do  processo  semiótico  relevante  à relação entre Direito/Estado e Religião, iluminando os fatores semântico-pragmáticos que encorajam Stein contra as contradições mencionadas.
AB This article presents a paradox in the thought of Edith Stein between her activities in relation to the State/Law problem and her vision of Religion. It seeks to explain the paradox trough the study of the Theory of the State and  Sovereignty.  In  this  regard,  basing  herself  on  classical  maters,  Edith Stein disagrees with the great jurists of her time who did not always recognize the priority of the concept of sovereignty. The examination of the relationship between the State and law breaks new ground within her phe-nomenological position, by, on the one hand, defending a strong concept of sovereignty of the State seen as a legal a priori while on the other hand staring  that  the  State  doesn’t  relate  to  spiritual  values.  This  leads  us  to propose it particular view of the semiotic processes relevant to the relation between Law/State and Religion, illuminating the semantic-pragmatic fac-tors which prompted Stein towards the above contradiction.
