Summary:Without diminishing the importance of the technically adequate analysis of the new norms on the matrimonial process, this reflection intends to focus on some provisions whose reception may require, on the part of the various protagonists, a renewed resource to the missionary foundation of the procedural discipline. This requires a prior clarification of what is meant by indicating the norma missionis as the foundation of canon law and its procedural order. Once this postulate has been clarified, we will try to show that the main innovations in the procedural sphere are not simply a work of stylistic renewal, but an authentic desire to manifest in a more appropriate way the missionary nature of the Church, as the common thread of all the legislative and magisterial work of Pope Francis.
Senza togliere importanza all’analisi tecnica delle nuove norme sul processo matrimoniale, questa riflessione intende focalizzarsi su alcune dispo sizioni la cui accoglienza può richiedere, da parte dei vari attori del settore , un rinnovato ricorso al fondamento missionario della disciplina processuale. Ciò richiede che si chiarisca preventivamente ciò che si vuole affermare indicando la norma missionis come fondamento del diritto canonico e del suo ordinamento processuale. Una volta definite tale postulato, si tenterà di dimostrare come le principali novità in ambito processuale non sono semplice opera di rinnovazione stilistica, ma autentico desiderio di manifestare in modo più adeguato la natura missionaria della Chiesa, quale filo conduttore di tutta l’opera legislativa e magisteriale di Papa Francesco.
