An Italian translation of this particular law is given and a first commentary that highlights above all the nature of these administrative tribunals and the relationship with the ordinary path of hierarchical appeals and administrative litigation. The problematic and unresolved issue of recourse to the Holy See is noted. It concludes with the annotation that the singularity of this particular law, unique in the entire Church, can constitute a model both for the establishment of administrative tribunals with general competence and for the establishment of privacy tribunals in other episcopal conferences. | ||
| 520 | |a L'articolo intende far conoscere la normativa particolare promulgata dalla Conferenza episcopale tedesca che istituisce Tribunali ecclesiastici per la protezione dei dati, ossia per giudicare le violazioni della legge ecclesiastica sulla privacy. Di questa legge particolare si da una traduzione italiana e un primo commento che mette in luce soprattutto la natura di questi Tribunali amministrativi e il rapporto con la via ordinaria dei ricorsi gerarchici e del ricorso contenzioso amministrativo. Si fa notare il nodo problematico e irrisolto del ricorso alla Santa Sede. Si conclude con l'annotazione che la singolarità di questa legge particolare, unica in tutta la Chiesa, puo costituire un modello sia per l'istituzione di Tribunali amministrativi a competenza generale sia per l'istituzione di Tribunali per la privacy in altre conferenze episcopali. | ||
