AB L'articolo - sforzandosi di proporre un approccio sia dottrinale, sia pratico - affronta l'esegesi della seconda condizione richiesta (al can. 1683, 2º) per la procedibilità del processus brevior, introdotto con la riforma del 2015: ossia la evidenza o natura manifesta del motivo di nullità prospettato. Nella prima parte dell'articolo, si analizza ilsignificato di tali concetti, nonché le circostanze richieste dalla legge per la relativa verifica. Nella seconda parte dello studio, si passano invece in rassegna tutte le circostanze esemplificate nell'art. 14 della Ratio procedendi come prodromiche all'utilizzo del processo breve, suggerendo che - anche al di là di dette esemplificazioni - ogni singolo caso andrà esaminato con intelligenza e senza precomprensioni, onde eventualmente attivare il processo breve in modo effettivamente rispondente ai seri requisiti previsti dal Legislatore.
AB The article - striving to propase both a doctrinal and a practical approach - deals with the exegesis of the second condition required for the processus brevior to be able to proceed (can. 1683, 2º): the evident or manifest nature of the ground of nullity envisaged. In the first part of the article, the meaning of these concepts is analysed, as well as the circumstances required by law for their verification. In the second part of the study, all the circumstances given as examples in art. 14 of the Ratio procedendi are reviewed as precursory to the use of the short process, suggesting that - even beyond these examples - each individual case should be examined with intelligence and without preconceptions, to consider the possibility of the briefer process in a way that actually meets the serious requirements set forth by the Legislator.
