Nella prima parte dell'articolo, si analizza ilsignificato di tali concetti, nonché le circostanze richieste dalla legge per la relativa verifica. Nella seconda parte dello studio, si passano invece in rassegna tutte le circostanze esemplificate nell'art. 14 della Ratio procedendi come prodromiche all'utilizzo del processo breve, suggerendo che - anche al di là di dette esemplificazioni - ogni singolo caso andrà esaminato con intelligenza e senza precomprensioni, onde eventualmente attivare il processo breve in modo effettivamente rispondente ai seri requisiti previsti dal Legislatore. | ||
