Summary: | The author demonstrates that a contract of marriage under Islamic law is an example of the presence of the Islamic religious law - sharia - in the practice of everyday life. The origins of the instituition of marriage date back to the beginnings of Islam, and the most important elements of the marriage contract are derived from the Quran and the Sunnah (tradition) of Prophet Muhammed. Although the contract appears to be rigorous, a party with adequate knowledge of sharia can shape it in a relativeley flexible way. Entering into a marriage results from signing a contract between the parties or their proxies. Similar to any other rooted in sharia law, the marriage contract must respect the rules for entering into contracts under Islamic law. Therefore, if the conditions stipulated by the law have been met, it can be concluded by a proxy |
