La nueva ley introduce modificaciones significativas, la más importante de las cuales es la del divorcio cincular en sus tres vertientes de divorcio sanción, de común acuerdo y unilateral o repudio. Como una manera de mitigar el impacto que ello suponía en una nación mayoritariamente católica, se ofreció la posibilidad de dar reconocimiento civil a los matrimonios celebrados en forma religiosa, para lo cual se tuvo a la vista de legislación española, si bien estaba la diferencia sustancial de la inexistencia de acuerdos entre el Estado y las confesiones religiosas. La regulación que finalmente se dio al tema desvirtuó por completo la idea original, de manera que en Chile es posible afirmar la subsistencia de un único y excluyente matrimonio civil cuya celebración , acorde con la nueva ley, reviste dos modalidades: una, sólo ante la autoridad civil y otra que, iniciada ante la autoridad relisiosa, ha de continuar y culminar ante la autoridad civil, pero en ésta el matrimonio sólo tiene valor civil a partir de las gestiones que se hacen ante esta última autoridad, desconociéndose lo realizado ante la autoridad religiosa. The new civil marriage law in Chile A new civil marriage law was published in Chile on May 17, 2004, thus replacing a law that had been in force since 1884. The new law introduces significant changes, the most important of which is the law of absolute divorce (divorce a cinculo matrimonii) in its three forms: sanction divorce, mutually agreed divorce and unilateral divorce or repudiation. In an attempt to mitigate the impact of this new legislation on a maily Catholic society, the possibility of giving civil recognition to religious marriages, following the model of Spanish legislatio, was contemplated. There was, however, one important difference - there are no agreements between the State and religious denominations. The final legislation on this issue completely distorted the original idea, so it is possible to say that in Chile there is only one civil marriage, in two modes. The first one is celebrated before the civil authorities and the second, having started before a religious authority, must also be concluded by a civil authority. In the latter case, the validity of the marriage begins with the procedures before the civil authority, which complete disregard fot any previous religious commitment | ||
