Similar issues arise when a priest already incardinated in the diocese has been absent for duties outside the diocese for a long period of time and wishes to return. Finally, it may well be that a priest has remained within the territory of the diocese but has worked.for an entity not subject to the diocesan bishop. All such priests have in common the fact that they fall within definitions of exclusionary clauses found in particular law or other pertinent documents that make them ineligible for the usual diocesan social assistance should they suffer from illness. Incapacity, or old age. Each such cleric presents a unique set of circumstances financially. Thus, the question arises in light of canons 269, 281 and 1274: What guiding principles ought to be incorporated into particular law and other documents emanating from a diocesan bishop to address these special circumstances? In a similar way, may individualized plans be crafted in accord with canonical equity to make provision for the social assistance necessary for such priests? In these cases, what present and future assets of such priests may be considered in evaluating their capacity to provide for their needs?" | ||
