Resumo:The present article deals with an issue concerning society as a whole, and the Chruch in particular. In these pages, the Argentinean Penal Code Legislation about sexual offences towards minors is analysed, taking into account the views of the most renamed attorneys. They discuss certain elements which could improve the law as well as fill in certain gaps in it. Special attention is drawn to what would happen if this sort of crimes were committed by clergymen, also if there were aggravating circumstances and to which extent that would enforce a more severe sentence. Additionally, a comparison is drawn between the way these offences are weighed by canonical and civil legislations -considering their diverse nature- with the purpose of demonstrating that the law of the Church has a broader approach than penal legislation towards this sort of offence. Finally, the article considers the question if it's an obligation for bishops and other superior clerical authorities to report priests who have committed this felony. The similarities between the Argentinean and Spanish Penal Codes and other Southamerican legislations will contribute to making this article useful for a wide range of readers
