Summary:The phenomenon of error accompanies personal and interpersonal stories therefore requiring the protection of the subjects by the legal system. In this context, the canonical Legislator has ratified as irrelevant any error that does not concern the substance of the juridical act. In the field of matrimonial canon law, the irrelevance of the error that concerns the unity, the indissolubility and the sacramentality of marriage as necessary consequences of the matrimonial pact has been affirmed. However, the interpretation of this norm has created difficulties for several years. This studiy aims to contribute to the debate by presenting, on the bases of previous doctrine, the course of the elaboration of the norm concerning the error of law during the process of the first canonical Codification, as well as the pertinent material preserved in the Archivi Secreti Vaticani and in the Archives of the Pontifical Gregorian University
