The issue is not merely theoretical but also practical, if canonical judgements obtain civil effects. Having recalled the common law origins of the process paradigm, the article examines the constituent elements of a fair trial: and adversial proceeding, respect for the rights of the defence, equality of arms between the parties, the independence and impartiality of the judge, the reasonable time of the proceeding. Such elements, albeit in the framework of the special nature of the law of the Church are present in canonical tirals. Said trial, it must be remembered, has itself been the model for trials in the Anglo-Saxon world. In conclusion, the author observes that the fairness of the canonical trial is ensured by two distinguishing features of the legal system of the Church: canonical equity and the principle of truth, according to which canon law does not content itself with trial truth | ||
