Riepilogo:I am advising the administration of a Catholic university that wants all of its theology professors to have the mandatum, but it seems that several professors have made it known that they will not request it "on principle. " The bishop is willing to grant them the mandatum anyway, since he believes they qualify for it, but the National Conference of Catholic Bishops procedures call for the professor to accept in writing a mandatum granted motu proprio. Is this written acceptance by the professor always necessary? Other questions are whether older professors are exempt from the requirement due to the non-retroactivity of law, and whether spirituality and religious education fall under the area of pastoral theology, requiring professors of these subjects also to have the mandatum.
