Für den vorliegenden Fall gelten nun in 2. Instanz die cann. 1682 §§ 1-2; 1683 und 1644 §§ 1-2, die im "In iure"-Teil unter Hinzuziehung der cann. 1684 §§ 1-2, 1685 und 1650 § 3 expliziert werden. Angesichts zwei vom Kläger angeführter Nichtigkeitsgründe kann der Richter aus dem Übergewicht des einen oder anderen Grundes, nach dem Vergleich der übrigen rechtlichen Elemente, leichter und sicherer ermitteln, wie sich die Sache verhält
