Gegen dieses Dekret appelliert der Kläger an die RR. Der Rechstteil geht auf altes und neues Recht ein. Das ablehnende Dekret der zweiten Instanz wird nicht bestätigt; die Berufung des Klägers gegen das erstinstanzliche Gericht wird zugelassen. Vgl. cann. 1595; 1709 CIC/1917
