Summary: | Despite the renewed interest in penal law occasioned by the ongoing scandal of clerical sexual abuse of minors, a number of theoretical questions regarding the canonical institute of prescription of criminal action remain disputed. This study describes the juridic foundations of prescription and addresses a number of these questions. It also offers an overview of the various reasons proposed in the doctrine for this institute. Malgré l’intérêt renouvelé dans le droit pénal en raison du scandale persistant des abus sur les personnes mineures par les clercs, il existe encore des controverses au sujet de certaines questions théoriques sur l’institution canonique de la prescription de l’action criminelle. Cette étude décrit les fondements juridiques de la prescription et répond à un bon nombre de ces questions. Il offre aussi un survol des diverses raisons proposées dans la doctrine pour cette institution. |
