Summary: | A grammatical analysis of c. 874 CIC reveals that neither the canon itself nor any of its individual requirements have an invalidating or disqualifying clause. In view of the absence of any such clause, by studying the structure of c. 874 § 1 (analysed as a whole), without examining any of its individual components (i.e. the individual criteria), the A. seeks to determine whether the canon may be considered an invalidating or disqualifying law. To this end, scholarly opinions concerning the said provisions are analysed, along with analogous norms provided in cc. 765-766 CIC/17 as well as c. 685 CCEO. Also considered are pertinent laws in force before CIC/17 and the reports of the consultors for the revision of the Code. Une analyse grammaticale du c. 874 CIC révèle que ni le canon lui-même ni ses exigences individuelles n’ont une clause irritante ou inhabilitante. Étant donné l’absence d’une telle clause, en étudiant la structure du c. 874, § 1 (analysé dans son ensemble), sans examiner aucun de ses composants individuels (c.-à-d. les critères individuels), l’A. cherche a déterminer si le canon peut être considéré comme une loi irritante ou inhabilitante. À cette fin, des opinions érudites concernant les dites clauses sont analysées, ainsi que des normes analogues retrouvées aux cc. 765-766 CIC/17 de même qu’au c. 685 CCEO. Sont également considérées des lois pertinentes en vigueur avant le CIC/17 et des rapports de consulteurs pour la révision du Code. |
