In jüngster Zeit werden aus ethischer wie rechtlicher Sicht stärker partizipative Regelungsmodelle für die biomedizinische Forschung diskutiert, die im geltenden Recht noch nicht abgebildet sind. Der Beitrag geht der Frage nach, ob und wie sich stärkere Partizipation insbesondere von Probanden und Spendern von Körpermaterialien am Prozess der biomedizinischen Forschung in rechtskonformer Weise ermöglichen ließe. Dabei steht die Frage im Mittelpunkt, inwieweit das Grundrecht der Forschungsfreiheit (Art. 5 Abs. 3 GG) offen für die Beteiligung Dritter am Forschungsprozess ist. Im Ergebnis lässt das Verfassungsrecht weiten Raum für die Etablierung von ethisch begründeten Partizipationsmodellen. | ||
| 520 | |a Biomedical law is a new field of law that has been dynamized by progress in the life sciences and has a fragmentary character so far. Its paradigms are the principles of voluntariness, informed consent and legitimacy by procedures. Recently, more participatory regulatory models for biomedical research have been discussed from an ethical and legal perspective, which are not yet reflected in current law. This article examines the question whether and how more participation, especially of test persons and donors of body materials, in the process of biomedical research could be made possible in a legally compliant manner. In doing so, the question is to what extent the fundamental right of freedom of research (Article 5 (3) of the German constitution) is open to the participation of third parties in the research process. As a result, constitutional law leaves wide scope for the establishment of participation models. | ||
