La garanzia del contraddittorio non è solo formale e cautelativa ma effettiva e sostanziale, essendo chiamato – secondo il richiamo di S. Giovanni Paolo II – a “indagare, proporre e chiarire tutto ciò che ragionevolmente si può addurre contro la nullità”. Si analizza pertanto il contenuto e lo spirito dell’intervento di tale ministro in tutta la dinamica del processo (fase introduttoria, istruttoria e discussoria e nel delicato compito legato all’eventuale impugnazione della sentenza episcopale). La funzionalità del processus brevior richiede Difensori del vincolo competenti e motivati, si rimarca quindi l’esigenza della sentita determinazione, dell’adeguata formazione e della dedizione prioritaria nella difesa del vincolo. | ||
| 520 | |a This article examines the role of the Defender of the Bond in the processus matrimonialis brevior, highlighting the importance of this prominent role in representing the public good throughout the various stages of this form of the process (especially given the active litis consortio of the spouses). Guaranteeing the existence of a process in contradictorio, the Defender is not just a formal, precautionary requirement; rather, it represents a real, substantial role that is required to – in the words of Pope St. John Paul II – “investigate, propose, and clarify all that could reasonably be cited against nullity.” This article, then, analyzes the content and spirit of this ministry’s contribution to the entire dynamic of the process (introduction, instruction, discussion, and the delicate task associated with a possible challenge against the Bishop’s sentence). Given that the functionality of the processus brevior requires competent and motivated Defenders of the Bond, this article notes the demand for sincere determination, adequate formation and unconditional commitment to defense of the bond. | ||

La garantía del contradictorio no es solo formal y cautelar sino efectiva y sustancial, estando llamada –según el requerimiento de san Juan Pablo II– a «indagar, proponer y clarificar todo aquello que razonablemente pueda aducirse contra la nulidad». Se analiza, por tanto, el contenido y el espíritu de la intervención de este ministro en toda la dinámica del proceso (fase introductoria, instructora y de discusión y en la delicada función ligada a la eventual impugnación de la sentencia episcopal). La funcionalidad del processus brevior requiere defensores del vínculo competentes y motivados, se destaca por lo tanto la exigencia de una comprometida determinación, de una formación adecuada, así como de una dedicación prioritaria en la defensa del vínculo. | ||
