| Summary: | Los últimos Sínodos sobre la familia de 2014 y 2015 han puesto de relieve la dificultad del hombre y de la mujer de hoy para conocer el designio de Dios sobre el matrimonio. Este artículo analiza los elementos jurídicos que constituyen la sustancia del matrimonio cristiano a la luz de las enseñanzas de los últimos tres pontífices de la Iglesia católica (Juan Pablo II, Benedicto XVI y Francisco). Se muestra que la Iglesia mantiene su enseñanza tradicional acerca del carácter natural de la institución matrimonial, afirmando la posibilidad de un conocimiento por connaturalidad. Se señala que la mediación de la cultura postmoderna puede dificultar conocer y querer el matrimonio según ha sido creado por Dios. La segunda parte del artículo aplica las categorías jurídicas esenciales del matrimonio a algunos aspectos de la reforma del proceso de nulidad matrimonial realizado por el Papa Francisco a través del Motu Proprio Mitis Iudex Dominus Iesus en 2015. The recent Synods of the Catholic Church on the family (in 2014 and 2015) have highlighted the difficulty people may experience in understanding God’s plan for marriage. This article analyzes the legal elements that constitute the substance of Christian marriage in the light of the teachings of the last three popes (John Paul II, Benedict XVI and Francis). It shows that the Church maintains its traditional teaching about the natural character of marriage as an institution, affirming the possibility of «connatural» knowledge (as described by St. Thomas Aquinas). The mediation of postmodern culture may compromise our understanding of marriage as planned by God. The second part of the article applies the essential legal categories of marriage to some aspects of the reform of the matrimonial nullity process carried out by Pope Francis in the Motu Proprio Mitis Iudex Dominus Iesus in 2015. |
