| 520 | |a L’istituto della supplenza, originato nel diritto pubblico romano, è stato poi introdotto nel diritto canonico antico e moderno, sviluppando proprie peculiarità in ordine alla natura, all’oggetto, al meccanismo operativo, ai presupposti e alla ratio propri, sulla base della distinzione tra la potestas iurisdictionis (possibile oggetto di supplenza) e la potestas ordinis sacerdotale (insuscettibile di essere supplita, in quanto originata per diritto divino dal sacramento dell’ordine sacro). Il can. 144 §2 costituisce la prima disposizione normativa esplicita circa l’estensione della supplenza alle tre facoltà ministeriali (di cresimare, di confessare e di assistere al matrimonio), anche se tale estensione era già ammessa dalla dottrina e dalla giurisprudenza rotale, seppure con qualche incertezza dottrinale circa la natura delle medesime facoltà. L’analisi dell’iter redazionale del can. 144 §2 aiuta a comprendere come le tre suddette facultates ministeriali ― che non sono potestates (né ordinis né iurisdictionis) ― pur con le dovute differenze reciproche (che vengono analizzate), abbiano una medesima natura che consiste nell’essere un prodotto della potestà di governo, finalizzato a liberare il pieno contenuto della potestà sacramentale: quest’ultima, per il bonum Ecclesiae, può essere e viene di fatto regolata dalla potestà di governo, fino a determinarne l’esercizio ad validitatem. L’istituto della supplenza, di conseguenza, dovrebbe trovare in tutti e tre gli ambiti previsti dal can. 144 §2 (cresima, penitenza, matrimonio) la medesima applicazione omogenea. | ||
| 520 | |a The extension of the supplying's institute to ministerial faculties (can. 144 §2) The juridical institute of “supplying”, originating in Roman public law, was subsequently introduced into ancient and modern canon law, developing its peculiarities in terms of nature, objects, working mechanism, premises and ratio on the basis of the distinction between the potestas iurisdictions (which can be possible object of supplying) and the sacerdotal potestas ordinis (which can never be an object of supplying, because it derives by divine right from the sacrament of sacred orders). Can. 144 §2 constitutes the first explicit normative provision concerning the extension of the first supplying to the three ministerial faculties, to confirm, to confess, and to assist at marriage, thought this extension was already admitted by canonists and rotal jurisprudence, albeit with some uncertainty about the nature of the same faculties. These faculties, which are not potestates (neither ordinis in this article), have mutual differences (which are studied in this article). However, the analysis of how can. 144 §2 developed helps us to understand the way in which the three ministerial faculties mentioned above have the same nature, namely, of being a product of the power of governance, aimed at freeing the full content of sacramental power: the latter, for the bonum Ecclesiae, can be and is in fact regulated by the power of governance, to the extent of determining its exercise ad validitatem. Consequently, the juridical institute of supplying should have the same homogeneous application in all three areas foreseen by can. 144 §2 (confirmation, penance, marriage). | ||
