La lotta che la Chiesa sta conducendo contro il flagello degli abusi sessuali contro i minori da parte del clero dovrebbe guidare il legislatore a rivedere e riformare tutte le norme in questo settore. Questo articolo si occupa dell'analisi degli attuali regolamenti penali, in particolare il can. l 395 §2, e lo fa a partire dai principi ecclesiologici e antropologici che devono essere considerati da parte del legislatore quando stabilisce gli elementi costitutivi del reato ecclesiastico.Una delle tesi centrali che cercheremo di dimostrare è che, nella Chiesa, interpretando rigorosamente le norme in questa materia, non è tipizzato il delitto di abuso sessuale sui minori, o se lo è, non lo è in rnodo coerente. Si rende necessaria, quindi, una modifica dell'attuale normativa alla luce della dottrina del bene giuridico protetto più in linea con la missione della Chiesa. Ciò significa abbandonare l'esclusiva considerazione del celibato nel crimine di can. 1395 §2 e considerare in primis la dignità del minore come bene da proteggere. | ||
| 520 | |a The penal status of the minor in can. 1395 § 2: critical analysis in the light of the doctrinal presuppositions of the penal theory of the legal good. The respect and protection of every child in Church law is rooted in the recognition of their dignity as a human person. The firm resolve of the Church to address the scourge of the sexual abuse of minors by clergy should guide the Legislator to review and reform all its norms in this area. This article deals with the analysis of the current penal regulations, in particular can. 1395 §2, starting from the ecclesiological and anthropological principles that must be considered by the Legislator when establishing the constituent elements of the ecclesiastical crime. One of the key thesis examined in this work is that, in the Church, strictly interpreting the rules in this matter, the crime of sexual abuse of minors is not typified and if it is, it is not in a consistent way. This necessitates modifying the current legislation in the light of the doctrine of the legal good to be protected so as to harmonize it with the mission of the Church. This means abandoning the exclusive consideration of the violation of celibacy in the crime of can. 1395 §2 and consider in primis the dignity of the minor as an asset to be protected from any abuse. | ||
