Il quadro che risulta è molto positivo, dal momento che la partecipazione e, come l'intera tradizione giuridica della Chiesa riporta, molto ampia sia quanto a facoltà sia quanto all'età precoce in cui è consentita sia quanto a strumenti processuali di garanzia. Ciò discende dal riconoscimento della dignità del minore e dei beni soprattutto spirituali ed ecclesiali che gli competono. L'analisi si estende anche all'ambito penale, amministrativo e contenzioso-amministrativo. | ||
| 520 | |a The article proposes to illustrate and comment upon the prescript of can. 1478 concerning minors' participation in a trial to vindicate their own rights. The resulting framework is quite positive, since their participation is, as evident in the entire juridical tradition of the Church, very broad as regards their faculties, the early age at which their participation is allowed, and the procedural instruments that guarantee the exercise of the right of participation. All this arises from the recognition of the dignity of minors and the goods, mostly spiritual and ecclesial, that pertain to them. The analysis extends also to the penal, administrative and contentious-administrative domain. | ||
