Le domaine de la brevetabilité dépend de la notion retenue à propos de l'embryon en raison d'un principe d'interdiction portant sur les utilisations d'embryons humains à des fins industrielles ou commerciales.Cette étude est consacrée à l'évolution de la notion à l'échelle européenne, particulièrement via les décisions rendues par la CJUE : en adoptant une notion évolutive de l'embryon en fonction des progrès scientifiques, le domaine de la brevetabilité s'étend et offre de nouvelles perspectives en matière de recherche. | ||

The field of patentability depends on the notion retained about the embryo because of a principle prohibiting the use of human embryos for industrial or commercial purposes.This study is devoted to the evolution of the concept on a European scale, particularly via the decisions made by the CJEU : by adopting an evolutionary notion of the embryo according to scientific progress, the field of patentability extends and offers new perspectives in research. | ||
