| Resumo: | The legal regulation of nursing robots is an important task for medical law and medical ethics. The starting point should be the fact that patients are fully entitled to fundamental rights and, in particular, human dignity, also when they receive nursing care. All law has to be judged in terms of its consistency with constitutional principles. Tort and criminal law are important areas of law in the context of robotic nursing. As a consequence of the use of machines, gaps in legal liability may exist in both areas. Data protection law, which so far does not cover data without reference to identifiable persons, is also important. There is therefore a strong case for Parliament taking action to amend the law to better deal with these new technologies. Die rechtliche Regulierung der Pflegerobotik ist eine wichtige Aufgabe von Medizinrecht und Medizinethik. Ausgangspunkt sollte die Tatsache sein, dass den Patienten auch im Pflegekontext uneingeschränkt Grundrechte und insbesondere auch Menschenwürde zustehen. Jede staatliche Regelung muss sich daran messen lassen. Wichtige Teilbereiche des Rechtsrahmens der Pflegerobotik sind das Recht des Schadensersatzes und der strafrechtliche Schutz. Auf beiden Feldern drohen infolge des Einsatzes von Maschinen Haftungslücken bzw. Verantwortungslücken. Wichtig ist zudem das Recht des Datenschutzes, welches aber bislang Daten ohne Personenbezug nicht umfasst. Es spricht deshalb viel dafür, dass der Gesetzgeber tätig werden sollte, um den Rechtsrahmen an die neuen Technologien anzupassen. |
