| Zusammenfassung: | L'articolo valuta il valore giuridico della divisione di funzioni di governo, quale tecnica che giova al rispetto dei diritti nei confronti dell'esercizio del governo, ed esamina fino a che punto essa sia applicabile alla Chiesa. Si studia di seguito come sia stata applicata la divisione di funzioni nell'articolato del Codice del 1983. Infine, si scandaglia quanto sia stata presente l'idea della divisione di funzioni nella Cost. Ap. "Pastor Bonus" e si esaminano in particolare le mansioni di tre dicasteri (il Pontificio Consiglio per i testi legislativi, la Segnatura Apostolica e la Congregazione per la dottrina della fede), i quali esercitano più di una funzione. L'articolo offre alcune considerazioni de iure condendo relative alle esigenze di giustizia presenti nell'organizzazione e nell'attività della Curia romana. The article considers the juridical value of the division of government functions as a technique that leads to the respect for the rights involved in the exercise of power, and examines to what extent it is applicable to the Church. Below it is studied how the division of functions has been applied in the Code of 1983. Finally, it is scaled down to how much the idea of division of functions has been present in the Cost. "Pastor Bonus". The article examines in particular the tasks of three ministries (the Pontifical Council for Legislative Texts, Apostolic Signature and Congregation for the Doctrine of the Faith), which exercise more than one function. The article offers some considerations de iure condendo regarding the needs of justice in the organization and activities of the Roman Curia. |
