Rileggendo il processo di secolarizzazione come progressiva discessio a fide, il testo evidenzierà poi il contrasto tra l'antropologia disegnata dalla secolarizzazione e gli elementi essenziali del matrimonio individuati dalla fede romano canonica. Il saggio si conclude suggerendo, anche alla luce del più recente magistero, alcune nuove piste interpretative del dato codiciale in ordine al riconoscimento della rilevanza che la fede può assumere in relazione alla valida formazione del consenso matrimoniale. This essay esamine the antropological and juridical dimensions of natural faith with particular reference to the fides romana, its assimilation by the new faith of the Christian Gospel, and the resultant Roman-canonical faith, which is at the basis of mediaeval societas Christiana and the canonical concept of marriage. With its depiction of the process of secularism as a discessio a fide, the essay underscores the contrast between the anthropology arising from secularism and the essential elements of marriage in the context of the Roman-canonical faith. It concludes with some proposals, drawn also from recent magisterium, about possible new interpretations of the canonical data regarding the relevance of faith in the formation of a valid matrimonial consent. | ||
