A livello canonistico il can. 213 chiede di essere letto alla luce di altri canoni collegati, soprattutto quelli riguardanti il dovere della Chiesa di provvedere perché tale diritto si realizzi sempre e ovunque. Pertanto la sua ricaduta di ordine pratico assume molteplici connotazioni: a quali condizioni questo diritto può essere rivendicato? E come fare là dove mancano le condizioni per realizzarlo? Il contributo intende delineare per cenni alcuni aspetti giuridici che scaturiscono dalla lettura del canone. The right of the faithful to accede to spiritual goods, especially the Word of God and the Sacraments, is found among the fundamental rights of the faithful and includes a number of consequences of a juridical and pastoral character. At a canonical level, can. 213 requires to be read in the light of other connected canons, above all, those regarding the Church to provide so that such right may always be fulfilled everywhere. Thus, its repercussion of a practical nature assumes a number of consequences: under which conditions is this right to be vindicated? And what should be done where there lack those conditions for it to be fulfilled? The contribution intends to delineate a suggestion of some juridicial aspects that result from the reading of this canon. | ||
