AB In questo articolo, tramite lo studio della giurisprudenza della Segnatura Apostolica circa la soppressione, unione e modifica di parrocchie (can. 515 § 2) e la riduzione ad uso profano non indecoroso di edifici sacri (can. 1222 § 2), si vuole da una parte evidenziare come l'istituto del contenzioso amministrativo abbia una chiara e valida funzione nella vita della Chiesa, che tuttavia necessita di perfezionamento, e dall'altra si intende mostrare il ruolo che riveste la giurisprudenza del Supremo Tribunale a beneficio di una corretta prassi amministrativa a favore del bene dei fedeli. Si può così cogliere il motivo per cui sia necessario ed utile che questa giurisprudenza sia pubblicata e conoscibile. In this article, through the study of the Apostolic Signatura jurisprudence about the suppression, merge and edit parishes (can. 515 § 2) and to profane but not sordid use reduction of sacred buildings (can. 1222 § 2), you want to be one part to highlight how the institution of administrative litigation has a clear and valid function in the life of the Church, which, however, needs refinement, and the other is meant to show the role played by the case law of the Supreme Court for the benefit of sound administrative practices in favor of the good of the faithful. It may as well grasp why it is necessary and useful that this jurisprudence is published, and knowable.
