| 520 | |a Dopo una stagione di relativa popolarità, l'interesse per l'istituto del sinodo diocesano sembra essersi affievolito nella vita delle chiese locali. Eppure esso resta un luogo di assoluta importanza, ancorché non unico, per la produzione della normativa a livello locale, perché contempera la dimensione sinodale della Chiesa con la potestà legislativa in capo al vescovo diocesano. L'articolo indaga sulla natura giuridica del sinodo diocesano, alla luce del rapporto tra chiesa universale e chiesa particolare, per riscoprirne la natura e individuarne il ruolo per l'oggi della Chiesa. Nell'attuale quadro di riscoperta della natura sinodale della Chiesa questo istituto, antico di secoli, può essere luogo in cui la funzione legislativa del vescovo si esercita nel rispetto della identità più profonda della comunità da lui presieduta. Ciò a condizione che si evitino alcune derive e si mantengano in una corretta relazione alcuni elementi teologici e giuridici: chiesa particolare e chiesa universale, potestà legislativa del vescovo e partecipazione del popolo di Dio, leggi universali e norme particolari, diritto e pastorale. After a period of relative popularity, interest in the diocesan synod seems to have waned in the the local Churches. The institution, however, remains one of absolute importance, among others, for the local production of norms, harmonizing the synodal dimension of the Church with the legislative power of the diocesan bishop. The article examines the juridical nature of the diocesan synod, in the light of the relationship between the universal Church and the particular Church, in view of rediscovering ist nature and buttressing ist role for today's Church. In this vein, this institution of ancient tradition could be the place in which the legislative function of the bishop is exercised with due recognition of the true identity of the community led by him. All this requires that some tendencies are avoided and that a number of theological and juridical elements are kept in the right perspective: the universal and particular Church, the legislative power of the bishop and the participation of the people of God, universal and particular laws, law and pastoral life. | ||
