Riepilogo: | In the hypothesis where the diocesan bishop, after careful evaluation and in respect to the norms of the Code, decides with an episcopal decree to reduce the church to profane use, taking off from it the dedicatio ad cultum [consecration for worship], there arises the problem of guaranteeing its non-sordid use (can. 1222). The contribution examines and presents the possibilities offered by law to the end of acquiring such goal. Firstly, the juridical instruments are examined which are made available by civil law in the case of the transfer of property of the unused church by donation or alienation, and thus the edifice losing also its ecclesiastical nature. The juridical instruments offered by public law are presented, and analyzed, particularly the indirect guarantee resulting from common law concerning issues relation to goods of cultural value from the moment when very frequently edifices of cult are edifices of historic-artistic and ethno-anthropological interest |
