Summary:The passive attitude of the defendant in marriage's nullity procedures is the more prevalent procedural position in practice. The paper discusses two ways in which this attitude of the defendant it manifest. On the one hand, the figure of the "declaration of absence", or "former rebellion". In addition, the figure of submission to the Court justice, which is not regulated in the CIC and it's only mentioned in an article in the Instruction Dignitas Connubii. We are provided practical information on how to proceed in these cases by the Courts. We analyze requirements, differences and canonical legal effects and their impact on civil approval of the canonical marriage annulment by the State
