Ello ha planteado al Derecho un reto que va más allá de la determinación de las reglas jurídicas que deben ser aplicadas a esos nuevos modelos de familia. La cuestión fundamental es aclarar por qué el Derecho se interesa por la familia, y para qué la regula. Así podremos saber cuál es la respuesta jurídica más adecuada. El presente trabajo intenta responder a esas cuestiones, para lo que toma como punto de partida las funciones estratégicas de la familia, y analiza la eficiencia de los diferentes modelos de familia para cumplir esas funciones. El trabajo finaliza con algunas propuestas para la revitalización del derecho de Familia. In the last years, citizens within societies have found new ways of organizing their emotional and familiar relationships. This fact has become a challenge to the law discipline, whose new responsibilities go boyond the determination of the legal rules that must be applied to these new family models. The research questions are why and for what purpose the law is interested in those family models. The answers will enable us to find out the most appropriate legal response. This paper attempts to answer these questions, setting the strategic functions of the family as a framework. Then, it analyzes and assess the efficiency of the existing family models to carry out those functions. Finally, some proposals are presented to revitalize the family law | ||
