Die dabei aufscheinenden Probleme des c. 1417 CIC (und des hiervon klar unterscheidbaren beneficium novae audientiae), einer Auswechslung der Prozessrechtsordnung, sowie der vom Delegierten Gericht vorgenommenen Litiskontestation werden erörtert. Abschließen wird der Versuch unternommen, allgemeine Lehren aus dem gefällten Urteil zu ziehen und die Entscheidung des delegierten Gerichts aus prozessrechtlicher Perspektive zusammenfassend zu würdigen
